Can a Gas Station Be Turned into Anything Besides a Gas Station in Massachusetts?

As a Keller Williams agent in Greater Boston, we run into a lot of strange residential real estate and  commercial situations.   In our office we have an internal message board so that we can help each other out. That is one of the huge benefits for being with a large branded company. In our office, people post their questions and our colleagues help out answering questions or share our domain expertise with one another.

Recently a question was posed within our office.   The question was around a prospective buyer who was potentially looking to buy a building that was previously used as an office and for an oil distributor.  There were large oil tanks on the property that were used in conjunction with the previous use of the property.

Here is how the question was posed…

“Do any of you know what would be required by the town and/or lender for the purchase of a building that was formerly used for an oil distributor? All tanks have been removed. Buyer is interested in using it for non-hazardous use (a custom sign shop). I’m thinking EPA test, etc.? I don’t know anything about this stuff…”

There was not much response from the group here at the office.  Over 10-12 years ago I was involved in residential project where the property was once used to quarry granite and sell to local builders back in the day to be used as foundation block for buildings.  Over time, the quarry was filled by various people with all kinds of material.

Through being involved with that property I  became aware of Massachusetts General Law 21E.

The actual chapter and name of the law is:

Chapter 21E: MASSACHUSETTS OIL AND HAZARDOUS MATERIAL RELEASE PREVENTION AND RESPONSE ACT

It is a section of the law that handles issues relating to hazardous materials.   I suggested the agent visit the MGL Section 21 Laws

In addition to that statute , there are various regulations relating to this, I passed along information about redevelopment of industrial types of properties. You can see more about the Massachusetts Brownfields Initiatives online below.

The Commonwealth of Massachusetts is committed to the cleanup and redevelopment of brownfields properties as a way to stimulate the economy and promote environmental protection goals…These are properties which may have been used as industrial sites.   I suggested to the agent that they take a look at The Massachusetts Guide to Redevelopment of Brownfields properties.

Do you know of any places which have been converted from Gas Stations into Something Else?

As a matter of fact, I know of two places in greater Boston where the properties were converted from the existing use of handling and distributing hazardous materials. The first place is in Walpole, MA. The property was previously a gas station on route 1A and it is now being used as a hair salon.  The name of the salon is Earthcare Salon

The second place is actually the Tasty Burger at Fenway Park.  The property there is really cool. They have roll up doors like a garage that are rolled up in the good weather to let the air in and open up the dining room. It’s really a cool concept.

I am sure that at one point these two properties had to have environmental studies, zoning changes and various soil types of tests completed in order to make use of the property in another manner.

Please note that I am residential realtor in Greater Boston and this outside of my scope, but definitely have contacts in the space if you are looking at taking on a project like the conversion of a gas station to another use.
